La caisse des intérêts

« En vérité, il arrivera une période au cours de laquelle personne parmi les gens ne manquera de consommer l’usure ; celui qui n’en mangera pas sera touché par sa poussière. »

Cette parole du Prophète (saws) est toute d’actualité. Aujourd’hui, nous sommes tous plus ou moins confrontés aux lois du système bancaire moderne. Nous voyons chaque année nos comptes en banque crédités d’intérêts. Cet argent n’est pas licite. Il convient de s’en débarrasser et de ne pas en tirer un profit personnel.

C’est à ce titre que nous vous proposons, ainsi que l’ont préconisé plusieurs cheikhs dans leurs fatwas, de nous faire parvenir si vous le souhaitez le montant des intérêts perçus chaque années sur vos livrets et autres comptes d’épargne afin que cet argent illicite puisse être utilisé à des fins bénéfiques. Il nous permettra ainsi de régler les frais de fonctionnement et de transactions bancaires et de consacrer l’intégralité des autres dons aux actions proprement dites.

Giving Away Interest From Bank Accounts
Question of Fatwa: Is it permissible to use interest money (accumulated without choice from bank accounts in countries like North America) for: (1) Needy people (2) Cover hospital expenses for people with insufficient funds (3) Tuition fees for needy students (4) Helping someone go for Hajj? In essense, how can one dispose off such money?
Anwser:
You should try your utmost effort to avoid investing in any interest bearing accounts. If for some reasons this was unavoidable in your place of residence, then you should dispose of this haram income to various charities. All of the charitable causes you have mentioned are accepted for the exception of Hajj, which must be performed from the purest of incomes, wa Allahu A’alam.

As-Salamu `Alaykum. I have sold a property with interest. I wanted to contribute it for building a mosque, but lately I have learned that this money is Haram. What do I need to do?
Answer:

Dear brother in Islam, we would like to thank you for showing keenness on knowing the teachings of Islam, and we appreciate the great confidence you have in us. We hope our efforts meet your expectations, yet we apologize for the late reply.
With regard to your question, Dr. Monzer Kahf, a prominent Muslim economist and counselor, answers:
“Interest one earns does not belong to that person according to the Shari’ah. In principle, earned interest must be returned to its payer. If the payer is an interest practitioner such as a bank, you do not return it to the payer because doing so would amount to helping the bank to make more evil transactions. It also makes you appear as a fool and Muslims must not put themselves in a position to be fooled by anyone. Consequently, the fatwa that is discussed and accepted by all contemporary Shari’ah scholars and that was adopted in the second conference of Shari’ah issues of Islamic banks held in Kuwait in 1994 suggests that we do not return earned interests to banks. This applies to the Muslims living in Muslim countries or in other countries. Such interest must be spent for the general welfare of Muslims and their communities.
As far as building Masjids (mosques) is concerned, it is the obligation of Muslims. This means that they must pay for building Masjids from their own money. While it is permissible to give interest to build Masjids, this kind of action is not preferable because interest is dirty. In fact, it is very often heard in Shari’ah scholar circles, if you ever use interest in building mosque facilities use it for the rest room structure not for the prayer hall structure.
I am personally of the view that we should give the earned interest to poor and needy Muslims or Muslims who are struggling to gain their political and territorial independence and leave the building of Masjids from our own (clean) money. It is better to keep Masjids clean of any Haram money.
Dear brother, I suggest that you should give this money to the poor and needy, general Islamic charitable causes and help those whose houses are being burnt in Palestine, Chechnya and India.
